AI-Generated Content

Content generated through our AI services is produced using automated systems. We do not guarantee the accuracy, quality, or appropriateness of AI-generated outputs. You are responsible for reviewing and ensuring any generated content is appropriate before using or sharing it.

Content License

You retain ownership of content you upload. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your content solely for the purpose of providing our services. This license terminates when you delete your content or account.

Generated Content Ownership

Subject to these Terms and applicable law, you may use AI-generated content created through your account for personal and commercial purposes. We make no representations regarding copyright ownership of AI-generated content.

6. Payment Terms

Credits and Subscriptions

Our services operate on a credit-based system. We offer subscription plans that include credits for generating content. By subscribing, you agree to pay the applicable fees as described at the time of purchase.

Billing

Subscription fees are billed in advance on a recurring basis depending on your chosen plan. Your subscription will automatically renew unless cancelled before the renewal date.

Payment Processing

All payments are processed securely through our third-party payment processor, Creem. We do not store your payment card details on our servers.

Refunds

Refunds are handled according to our Refund Policy. Unused credits do not carry over between billing periods unless otherwise specified in your plan.

7. Intellectual Property Rights

Our Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, software, and underlying AI models, are owned by Genera or its licensors and are protected by intellectual property laws.

Feedback

Any feedback, suggestions, or ideas you provide about our services may be used by us without any obligation to compensate you.

8. Third-Party Services

Our services rely on third-party AI models, cloud infrastructure, and payment processors. We are not responsible for the availability, accuracy, or performance of these third-party services. Our services may also contain links to third-party websites that are not owned or controlled by Genera.

9. Disclaimers

Service Availability

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, secure, or error-free.

AI Output Quality

AI-generated content may contain artifacts, inaccuracies, or unexpected results. We make no representations or warranties about the quality, accuracy, or suitability of any AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by law, Genera and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from our services
• Any issues with AI-generated content, including inaccuracies or unintended outputs
• Any errors or omissions in any content

11. Indemnification

You agree to defend, indemnify, and hold harmless Genera and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of our services, your uploaded content, your use of AI-generated content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

• Your right to use our services will immediately cease
• Any unused credits will be forfeited
• We may delete your uploaded content and generated outputs

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Genera operates, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in that jurisdiction.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of our services after such changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
